took the case as recently in 2003, in a michigan case, the justices said that race could be one of the criteria used in admissions. does it seem to you that they're revisiting that judgment? >> they're certainly revisiting that judgment and part of it is because how that judgment played out. what happened in the case you're referring to, gruter versus university of michigan, was that they basically said that, sandra day o'connor said in her opinion schools should try first to use race neutral means. now, university of texas was doing that, they have a law called the top 10% law which basically requires the school to admit the top 10% of high school students across the state. >> from any high school. >> from any high school across the state. so, this means that diversity on campus has increased enormously and actually is higher at about 25% than it was under racial preferences, at about 21%. and so, they were, they've put racial preferences on top of that. the question is whether this is necessary or appropriate. >> paul: since the gruter decision you had sandra day o'connor repl
he returned home to michigan this week after his third tour of duty in afghanistan. elaine quijano reports it's been a long journey from the battlefield to a high school homecoming. >> reporter: the homecoming game in michigan always draws a big crowd. but this year was special. they welcomed home one of their favorite football stars, a man who went on to become army staff sergeant travis mills. >> this is awesome. okay. yeah. >> reporter: mills was on his third tour in afghanistan. in april a bomb exploded beneath him. >> sat my bag down and five, six seconds later i woke up on the ground. >> reporter: his 6'3", 250 pound body bore the brunt of the blast. two other men were wounded. he woke up at a military hospital in germany four days later. >> you turned 25 years old and you're told you don't have any arms or legs. what goes through your mind? >> i thought of my soldiers. how are they doing. and then i guess i was rejecting my wife's phone calls. i was embarrassed. i didn't want to talk to anybody. >> what were you embarrassed about? >> i felt i was a horrible person, i did som
of them in southern oregon, the other one in... the upper part of the lower peninsula of michigan. there were suddenly a large number of people in relatively small communities with very severe, bloody, diarrheal illness. and when these people went to the health care providers, the health care providers took specimens, tested them for the bugs that they knew caused that type of bloody diarrhea and came up with nothing. they turned first to the local, then to the state public health department, and when that didn't turn up any answers, the state asked the cdc for assistance. and so in circumstances where people can't come up with the causative agent, those specimens can then come into our laboratories, d we can run tests for a variety of different things that are both known and unknown. and that's what we did in that particular situation. and one of the things that we noticed is that we found that there were unusual e. coli in several of the specimens that were submitted to us from both oregon and from michigan. now, everyone normally has e. coli in their g.i. tract. it's a normal i

inland. officials in chicago are warning people to stay away from lake michigan because of high waves that could stop on lake michigan 24'. we are tracking the storm in the fox weather center right now. a massive rescue is underway up and down the state of new jersey where the pictures on the screen do not tell the whole story. in the state of new jersey, more than two million people are without power, hundreds of people are stranded right now in flooded towns up and down the jersey shore. the record storm surge flooded the barrier islands including atlantic city and seaside heights. it damaged dozens upon dozens of homes. this video is from seaside heights where a couple of seasons of "jersey shore" were filmed. travel in and out of the islands is banned until further notice. the governor of new jersey said there was not a place to land the helicopter. many streets are flooded. if they are not they filled with sand and debris and unrecognizable. in atlantic city the piers and boardwalks have washed to sea including several hundred feet of the atlantic city historic boardwalk. going n
